Deadmau5 continues battle for ‘Meowingtons’ trademark

Deadmau5 has filed a countersuit against Emma Bassiri (owner) and Scott Hutchinson (manager) of meowingtons.com. He and his counsel argue the website and trademark are confusing his fans and damaging the goodwill of himself and his pet feline.

Deadmau5 first took exception with Bassiri in early 2017, when he filed a petition with the United States Patent and Trademark office challenging her trademark. Bassiri responded with a suit of her own.

“[A] simple Google search of ‘Meowingtons’ at the time would have shown both a link to deadmau5 and his use of MEOWINGTONS in commerce in connection with, at the very least, deadmau5’s music," states the countersuit. "If Counter-Defendants indeed engaged in diligence prior to adopting the MEOWINGTONS mark, they would have promptly uncovered deadmau5’s use of the mark."

Deadmau5 further points out that "tens of thousands of units" featuring his cat’s moniker were sold between 2011 and 2014; the year Bassiri first used the mark.

Exclusive merch continues to be a passion for Deadmau5 and as the trial escalates, he seeks forfeiture of the meowingtons.com domain plus disgorgement of profits from the site or statutory damages.
